Terms of Use

Welcome to Tosta! These Terms of Use ("Terms") are an agreement between you and Embergrove Software LLC, a California company ("we", "us"), for playtosta.com and the games on it ("Tosta"). By using Tosta, you agree to these Terms and to our Privacy note. If you don't agree, please don't use Tosta. If you're under 18, please read these Terms with a parent or guardian.
1. Free games, no account
- Tosta's games are free to play in your web browser. There's nothing to buy.
- You don't need an account. Your progress is saved in your own browser. We can't see it or restore it, so if you clear your browser data or switch devices, your progress may be lost.
- Coins, shells and anything else you earn in the games are just for fun. They have no money value and can't be exchanged for anything.
2. Crumbs
You can earn Crumbs by playing. They're a virtual item for use on playtosta only: they have no cash value, can't be exchanged for money, and are stored in your browser on this device, so clearing your browser data can remove them. We may change how Crumbs are earned or used.
3. Kawa Royale is separate, and for adults only
Kawa Royale, our flagship game, is for adults 21 and over. It runs on its own site under its own Terms of Service and Privacy Policy. We ask for your date of birth before we send you there. Please don't go there if you're under 21.
4. Our email list
You can join our email list to hear about new Tosta games. You need to be 13 or older to join. You can unsubscribe at any time with the link in any email.
5. Play fair
When you use Tosta, please don't:
- try to break, overload or get around the security of the site;
- copy, scrape or download the site or its games in bulk, or use bots to do so;
- copy our games, characters, art or music to use somewhere else;
- use Tosta for anything unlawful.
6. Our games and characters
The games, characters, artwork, music, sounds and the Tosta name and logo belong to Embergrove Software LLC or the people who license them to us, and are protected by intellectual property laws. You may play the games for your own personal, non-commercial fun. You can share links to Tosta and post your own screenshots and clips of yourself playing. We keep all other rights.
7. Ideas and feedback
If you send us ideas or feedback, we may use them to improve Tosta without owing you anything.
8. Changes to Tosta
We're still building Tosta. We may add, change, reset or remove games and features at any time, and we don't promise that the site will always be available or free of errors.
9. Disclaimers
TOSTA IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some places don't allow these exclusions, so some of them may not apply to you.
10. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, EMBERGROVE SOFTWARE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA OR GAME PROGRESS, ARISING FROM YOUR USE OF TOSTA, AND OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO TOSTA IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100). Some places don't allow these limits, so some of them may not apply to you. Nothing in these Terms limits liability that can't be limited by law.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. If you have a problem, please email us first at support@playtosta.com; most things can be sorted out that way. Any dispute that can't be resolved informally will be decided in the state or federal courts in Fresno County, California, except that either of us may bring a claim in small claims court if it qualifies.
12. Changes to these Terms
We may update these Terms. We'll post the new version here and update the date at the top. If you keep using Tosta after that, you accept the updated Terms.
13. General
If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a part of these Terms, we haven't given up the right to enforce it later. These Terms and our Privacy note are the whole agreement between you and us about Tosta.
